What Information We Collect 
At www.lyoness.ph Lyoness Philippines Inc. and its affiliates including Lyoness Asia-Pacific Limited (based in Hong Kong) and Lyoness Group AG (based in Austria) (“Lyoness” or “we”) aim to provide our members with the most current shopping information and keep them informed of the best deals on relevant products, in order to maximize their rewards under the Lyoness Loyalty Program or Lyconet Marketing Program. The primary way we accomplish these goals is by utilizing the power of our consumer membership base to gain access to special deals and promotions and to nego-tiate sales commissions from well-known national retailers, as well as specialty boutiques (our “Loyalty Merchants”). We then share this commission with you, as a Lyoness Member or Marketer. Consequently, when you first register with Lyoness, Lyconet, use our website www.lyoness.com or apply for a job on the Lyoness job portal, we ask you to provide your personal information including your name, email address and mobile phone number, date of birth, bank details and other information.

Using Your Information
We use your personal information to operate the Lyoness Loyalty Program / Lyconet Marketing Program and for other activities in our business, and in our efforts to expand and improve our business. Examples include:

 

  • to respond to and process your requests such as for information, products or services;
  • to process your membership application when you apply to join the Lyoness Loyalty Program / Lyconet Marketing Program;
  • to administer and operate the Lyoness Loyalty Program / Lyconet Marketing Program, including processing, calculating and recording any of your benefits under the Lyoness Loyalty Program or Lyconet Marketing Program;
  • to confirm your identity, such as when you contact our Member inquiry line;
  • if you have previously consented to us, to provide you with marketing communications, newsletters and invitations and offers for products and services offered by Lyoness, our Loyalty Merchants or service providers as part of the Lyoness Loyalty Program, including new products and services that we or our Loyalty Merchants or service providers have not offered our Lyoness members before but we believe may be of interest to you (and we will provide you with an opportunity to opt out) and to assist in developing new products and services;
  • to notify you about any changes to our services, including our membership terms and conditions;
  • to administer promotional programs, such as promotions or competitions, sweepstakes, rewards and rebate programs, including exclusive member offers linked to our Lyoness Loyalty Program, the Lyconet Marketing Program or our Loyalty Merchants;
  • to operate programs and forums in different media in which you are able to share information, including your personal information, with us and publicly (on the terms applicable);
  • to determine if you are eligible for certain products, services or offers;
  • for a business or professional relationship we may have with you;
  • if you apply for employment with us, to consider your application;
  • to amend records to remove personal information;
  • for other everyday business purposes that involve use of personal information.

We may also collect, from your navigation of our websites and the websites of our Loyalty Merchants, information about which part(s) of our websites and/or the websites of our Loyalty Merchants that you have visited. We collect this information to ensure that you receive your rewards and to better understand the types of stores and specials on which we may focus our marketing. Once logged into the Lyoness portal, if you visit one of the online shops of our Loyalty Merchants to make a purchase, the transaction is reported by the Loyalty Merchant directly to Lyoness. This notification helps to ensure that your rewards are properly credited to your account. No individual payment information is received by our Site.

Cookies and Web-tracking
Our websites use cookies. These are small text files which are stored in your computer and can be retrieved. The purpose of cookies is to enable you to subscribe to our services and to personalize the presentation of our websites for you.

You can access some of our website offers without having to register and/or log in. In this case certain information will be gathered automatically in order to collect statistical data regarding the usage and efficiency of our web offers and to adapt them to the needs of our users.   • to other companies in the Lyoness group (listed online at http://www.lyoness-corporate.com/en-US/Company/Organisation/);
  • to others, like our agents, contractors and service providers, who help us to provide services to you, provided that we require them to abide by this Privacy Policy Statement;
  • to our Lyoness Loyalty Merchants (listed online at www.lyoness.ph, some of whom may be located outside the Philippines);
  • in other ways that come up in our business from time to time.

As a worldwide shopping community, your personal information may be held and processed overseas by our related companies (including in Liechtenstein) or our service providers (located in countries including the United States, Hong Kong, Austria and the Philippines).

When we pass on or share your personal information in this way, we take steps to ensure it is treated in the same way that we would treat it.

We do our best to keep our records of your personal information up to date and accurate and not to keep personal information that is no longer needed.

Your privacy as related to our Loyalty Merchants
In order to grant your benefits, our Loyalty Merchants pass back to us the amount of your order as well as your unique Member ID. With these two pieces of information, we are able to make sure the right benefits goes to the right person. Our websites contain links to the websites of our Loyalty Merchants. Each of the Loyalty Merchants maintains its own privacy statements/policies and we encourage you to read these individual policies. We can neither enforce nor monitor the privacy statements/policies of the Loyalty Merchants. This Privacy Policy Statement applies solely to information collected by Lyoness (on our websites or other means). Lyoness does not bear any responsibility for any actions or policies of third-party websites including all framed sites. Moreover, Lyoness disclaims all responsibility for the subsequent use of an email address or any other personally identifiable information you have provided to Loyalty Merchants.

Employment
If you apply for one of the jobs advertised on our Lyoness job portal www.lyoness-corporate.com, you will be asked to fill out an application and/or upload information, which will contain any one of your following personal information:

The personal information we collect and save are your title, first name, last name, address including street address, ZIP/post code (if any) and city, date of birth, native language, nationality, Email address, telephone number, highest completed level of education, expected salary, current gross annual salary and earliest start date. In addition, you can list any special knowledge and qualifications such as IT skills, language skills, etc. In addition you can provide information regarding your education and training, professional experience, etc. These personal information are collected by Lyoness Group AG, located in Graz, Austria.

You also have the option of uploading files onto our server such as, e.g. your curriculum vitae, personal statement, photo, transcripts, and any additional information relevant to the job. In addition, you can send us a message in the text field provided for this purpose. These are also collected by Lyoness Group AG, located in Graz, Austria.

If you apply for a job located in the Philippines, Lyoness Group AG will transfer the collected personal information aforementioned to Lyoness Philippines Inc. or its parent corporation Lyoness Asia-Pacific Limited, located in Hong Kong, for the processing of your application. All personal information collected will be for the processing and considering of your job application only and be kept in strict confidence. Should your application is unsuccessful, all personal information collected will be destroyed within 6 months of the application date. 

How you can change, correct, update and request to destroy your information
As a Lyoness Member/Marketer or job applicant, you can change or rectify the information we have on file for you at any time, simply by logging in and making your desired changes, or you can request to have your personal information in our system destroyed if you are able to substantiate that such information is outdated, false, unlawfully obtained or no longer necessary for the purposes for which it was collected, by sending a request to office@lyoness.ph. However, you are advised that without your personal information, we may not be able to process any rewards earned by you through your transactions with the Loyalty Merchants, and we reserve the right to terminate your Contract (as defined under the General Terms and Conditions for Lyoness Members – the “GTCs”) between you and Lyoness on this basis. Upon enrollment, Lyoness Members are opted-in to receive Lyoness Cashback newsletters and special email promotions. Lyoness announces its latest deals and special offers in these emails, sometimes before they are posted on our Site. In every one of these emails you are given the choice to unsubscribe from the mailing. You may also login to our website and change your email preferences. For your security, you will be prompted to login before updating any account information. Please allow up to 7 days to process your email request or account changes. You may receive several additional emails from us while we are processing your unsubscribe request.

Miscellaneous
As Lyoness changes and grows, we might sell or buy companies, subsidiaries, or assets. In such transactions, customer information generally is one of the transferred business assets. Also, in the event that Lyoness or substantially all of its assets are acquired, your member information may be one of the transferred assets. By enrolling in the Lyoness Loyalty Program, you agree that you have read, understood and agreed with this Privacy Policy Statement, and the GTCs (and Lyconet Agreement if applicable), in its entirety and you consent to be bound by all the terms and conditions in this Privacy Policy Statement as well as the GTCs (and Lyconet Agreement if applicable). You further acknowledge the right of Lyoness to change this Privacy Policy Statement, without prior notification, and our commitment to post any such changes on this page so that you are fully informed. We encourage our members to check back from time to time to view the most recent version of this Privacy Policy Statement.

Governing Law
This Privacy Policy Statement shall be governed by and construed in accordance with the laws of the Republic of the Philippines.
